Afghanistan

SC Resolution 1267, 15 October 1999 (S/RES/1267)

"The Security Council,

… Acting under Chapter VII of the Charter of the United Nations,

[paragraph 2]… Demands that the Taliban turn over Usama bin Laden without further delay to appropriate authorities in a country where he has been indicted, or to appropriate authorities in a country where he will be returned to such a country, or to appropriate authorities in a country where he will be arrested and effectively brought to justice;

Decides that on 14 November 1999 all States shall impose the measures set out [in the paragraph immediately below], unless the Council has previously decided, on the basis of a report of the Secretary-General, that the Taliban has fully complied with [its] obligations [relating to Usama bin Laden outlined above];

Decides further that, in order to enforce [these obligations], all States shall:

(i)Deny permission for any aircraft to take off from or land in their territory if it is owned, leased or operated by or on behalf of the Taliban as designated by the Committee established  … below …;

(ii)Freeze funds and other financial resources … owned or controlled by the Taliban … except as may be authorised by the Committee on a case-by-case basis on the grounds of humanitarian need;

    (a)… Decides to establish … a Committee of the Security Council consisting of all the members of the Council to … report on its work to the Council with its observations and recommendations;

… Decides to terminate the measures imposed by [sections (i) and (ii)] above once the Secretary-General reports to the Security Council that the Taliban has fulfilled the obligation set out in paragraph 2 above;"

 

Angola

SC Resolution 1268, 15 October 1999 (S/RES/1268)

"The Security Council,

… Authorises the establishment, for an initial period of six months until 15 April 2000, of the United Nations Office in Angola (UNOA) staffed with the personnel necessary to liaise with the political, military, police and other civilian authorities, with a view to exploring effective measures for restoring peace, assisting the Angolan people in the area of capacity-building, humanitarian assistance, the promotion of human rights, and co-ordinating other activities;

Decides that, pending further consultations between the United Nations and the Government of Angola, UNOA will consist of up to 30 substantive professional staff, as well as the necessary administrative and other support personnel;

Stresses that the United Nations Humanitarian Assistance Co-ordination Unit (UCAH) will continue to operate and to be funded in its present configuration;

… Expresses its readiness to review the configuration and mandate of the United Nations presence in Angola upon the recommendation of the Secretary-General in consultation with the Government of Angola;"

 

Terrorism

SC Resolution 1269, 19 October 1999 (S/RES/1269)

"The Security Council,

… Calls upon all States to take, inter alia, in the context of such co-operation and co-ordination, appropriate steps to:

co-operate with each other, particularly through bilateral and multilateral agreements and arrangements, to prevent and suppress terrorist acts, protect their nationals and other persons against terrorist attacks and bring to justice the perpetrators of such acts;

prevent and suppress in their territories through all lawful means the preparation and financing of any acts of terrorism;

deny those who plan, finance or commit terrorist acts safe havens [sic] by ensuring their apprehension and prosecution or extradition;

take appropriate measures in conformity with the relevant provisions of national and international law, including international standards of human rights, before granting refugee status, for the purpose of ensuring that the asylum-seeker has not participated in terrorist acts;

exchange information in accordance with international and domestic law, and co-operate on administrative and judicial matters in order to prevent the commission of terrorist acts …;"

 

Sierra Leone

SC Resolution 1270, 22 October 1999 (S/RES/1270)

"The Security Council,

Decides to establish the United Nations Mission in Sierra Leone (UNAMSIL) with immediate effect for an initial period of six months and with the following mandate:

    (a)To co-operate with the Government of Sierra Leone and the other parties to the Peace Agreement in the implementation of the Agreement;

    (b)To assist the Government of Sierra Leone in the implementation of the disarmament, demobilisation and reintegration plan;

    (c)To that end, to establish a presence at key locations throughout the territory of Sierra Leone, including at disarmament/reception centres and demobilisation centres;

    (d)To ensure the security and freedom of movement of United Nations personnel;

    (e)To monitor adherence to the cease-fire in accordance with the cease-fire agreement of 18 May 1999 (S/1999/585, annex) through the structures provided for therein;

    (f)To encourage the parties to create confidence-building mechanisms and support their functioning;

    (g)To facilitate the delivery of humanitarian assistance;

    (h)To support the operations of United Nations civilian officials, including the Special Representative of the Secretary-General and his staff, human rights officers and civil affairs officers;

    (i)To provide support, as requested, to the elections, which are to be held in accordance with the present constitution of Sierra Leone;

Decides also that the military component of UNAMSIL shall comprise a maximum of 6,000 military personnel, including 260 military observers, subject to periodic review in the light of conditions on the ground and the progress made in the peace process, in particular in the disarmament, demobilisation and reintegration programme …;

Decides further that UNAMSIL will take over the substantive civilian and military components and functions of UNOMSIL as well as its assets, and to that end decides that the mandate of UNOMSIL shall terminate immediately on the establishment of UNAMSIL;

Commends the readiness of ECOMOG to continue to provide security for the areas where it is currently located, in particular around Freetown and Lungi …;

… Acting under Chapter VII of the Charter of the United Nations, decides that in the discharge of its mandate UNAMSIL may take the necessary action to ensure the security and freedom of movement of its personnel and, within its capabilities and areas of deployment, to afford protection to civilians under imminent threat of physical violence, taking into account the responsibilities of the Government of Sierra Leone and ECOMOG;

Underlines the importance of including in UNAMSIL personnel with appropriate training in international humanitarian, human rights and refugee law, including child and gender-related provisions, negotiation and communication skills, cultural awareness and civilian-military co-ordination;"

 

East Timor

SC Resolution 1272, 25 October 1999 (S/RES/1272)

"The Security Council,

… Acting under Chapter VII of the Charter of the United Nations,

Decides to establish … a United Nations Transitional Administration in East Timor (UNTAET), which will be endowed with overall responsibility for the administration of East Timor and will be empowered to exercise all legislative and executive authority, including the administration of justice;

Decides also that the mandate of UNTAET shall consist of the following elements:

    (a)To provide security and maintain law and order throughout the territory of East Timor;

    (b)To establish an effective administration;

    (c)To assist in the development of civil and social services;

    (d)To ensure the co-ordination and delivery of humanitarian assistance, rehabilitation and development assistance;

    (e)To support capacity-building for self-government;

    (f)To assist in the establishment of conditions for sustainable development;

Decides further that UNTAET['s] main components will be:

    (a)A governance and public administration component, including an international police element with a strength of up to 1,640 officers;

    (b)A humanitarian assistance and emergency rehabilitation component;

    (c)A military component, with a strength of up to 8,950 troops and up to 200 military observers;

Authorises UNTAET to take all necessary measures to fulfil its mandate;

Democratic Republic of the Congo

SC Resolution 1279, 30 November 1999 (S/RES/1279)

"The Security Council,

… Decides that the personnel authorised under its resolutions 1258 (1999) and 1273 (1999), including a multidisciplinary staff of personnel in the fields of human rights, humanitarian affairs, public information, medical support, child protection, political affairs and administrative support, which will assist the Special Representative, shall constitute the United Nations Organisation Mission in the Democratic Republic of the Congo (MONUC) until 1 March 2000;

Decides also that MONUC, led by the Special Representative of the Secretary-General, consistent with resolutions 1258 (1999) and 1273 (1999), shall carry out the following ongoing tasks:

    (a)To establish contacts with the signatories to the Cease-fire Agreement at their headquarters levels, as well as in the capitals of the States signatories;

    (b)To liaise with the JMC and provide technical assistance in the implementation of its functions under the Cease-fire Agreement, including in the investigation of cease-fire violations;

    (c)To provide information on security conditions in all areas of its operation, with emphasis on local conditions affecting future decisions on the introduction of United Nations personnel;

    (d)To plan for the observation of the cease-fire and disengagement of forces;

    (e)To maintain liaison with all parties to the Cease-fire Agreement to facilitate the delivery of humanitarian assistance to displaced persons, refugees, children, and other affected persons, and assist in the protection of human rights, including the rights of children;

Underlines that the phased deployment of United Nations military observers with the necessary support and protection elements in the Democratic Republic of the Congo will be subject to its further decision …;"

 

Iraq

"The Security Council,

… Acting under Chapter VII of the Charter of the United Nations,

… Decides to establish, as a subsidiary body of the Council, the United Nations Monitoring, Verification and Inspection Commission (UNMOVIC) which replaces the Special Commission established pursuant to paragraph 9 (b) of resolution 687 (1991);

Decides also that UNMOVIC … will establish and operate … a reinforced system of ongoing monitoring and verification, which will implement the plan approved by the Council in resolution 715 (1991) and address unresolved disarmament issues, and that UNMOVIC will identify, as necessary in accordance with its mandate, additional sites in Iraq to be covered by the reinforced system of ongoing monitoring and verification …;

Expresses its intention, upon receipt of reports from the Executive Chairman of UNMOVIC and from the Director General of the IAEA that Iraq has co-operated in all respects with UNMOVIC and the IAEA … for a period of 120 days after the date on which the Council is in receipt of reports from both UNMOVIC and the IAEA that the reinforced system of ongoing monitoring and verification is fully operational, to suspend with the fundamental objective of improving the humanitarian situation in Iraq and securing the implementation of the Council's resolutions, for a period of 120 days renewable by the Council, and subject to the elaboration of effective financial and other operational measures to ensure that Iraq does not acquire prohibited items, prohibitions against the import of commodities and products originating in Iraq, and prohibitions against the sale, supply and delivery to Iraq of civilian commodities and products other than those referred to in paragraph 24 of resolution 687 (1991) or those to which the mechanism established by resolution 1051 (1996) applies …;"
