(F) Pre-Investigation Procedures [Activities] - Field Investigations

Designation of the area under investigation

26(bis). The area [specified] [designated] for the field investigation by the requesting State Party shall be [designated] [specified] as precisely as possible by providing the geographic co-ordinates within which the affected area falls. [Whenever feasible] the requesting State Party shall also submit a map specifying the area under investigation as well as the geographic characteristics of the area.

Issue of investigation mandate

28. The [Director-General] shall [issue] an investigation mandate for the conduct of the [facility] [site]or field investigation. The investigation mandate shall be the investigation request put into operational terms, and shall conform with the investigation request.

Notification

32(bis). The [Director-General] shall, immediately acknowledge receipt to the requesting State Party of its request for a field investigation and inform the Executive Council and all States Parties.

32(ter). If applicable, the Director General shall, not later than [12] hours prior to the arrival of the field investigation team at the point of entry, notify the State Party on whose territory the investigation has been requested. The Director General shall also notify other States Parties if access to their territories might be required during the investigation.

32( ). The investigated State Party shall acknowledge receipt of the notification by the Director General no later than [2] hours after having received the notification.

Time-frame for an Investigation

35(bis). The estimated period of duration of a field investigation shall be indicated in the investigation mandate and finalised after the pre-investigation briefing and shall not exceed that time unless extended by agreement of the investigated State Party.

Pre-investigation briefing

41(bis). In the case of field investigations, the investigation team shall have the right to be briefed by representatives of the investigated State Party upon arrival and at any time during the investigation according to the guidelines as set out in Annex D.

Investigation Plan

42(bis). Before the commencement of a field investigation, the investigation team shall prepare an investigation plan to serve inter alia as a basis for logistical and safety arrangements. The investigation plan shall be updated as need arises.

Situation report

42(ter). The field investigation team shall, not later than 24 hours after its arrival on the territory of the investigated State Party, send a situation report to the Director General. It shall further throughout the investigation send progress reports as necessary.
